controller or a third party, and categories of recipients.
3.1 Accessing our website/applications
3.1.1 Log files
Each time websites/applications are accessed, information is sent to the server of our
website/application by the respective internet browser of your respective end
device and temporarily stored in log files, the so-called log files. The data
records stored in this process contain the following data, which are stored
until automatic deletion: Date and time of access, name of the page accessed,
IP address of the requesting device, referrer URL (URL from which you came to
our website), the amount of data transferred, loading time, as well as product
and version information of the browser used and the name of your access
provider.

3.1.2 Cookies, tracking, targeting procedures, social media plug-ins
We use cookies, tracking tools, targeting methods and social media plug-ins for our
website/application. The exact procedures involved and how your data is used
for this purpose are explained in detail below.
3.2 Establishment, performance and/or termination of a contract
3.2.1 Data processing upon conclusion of the contract
When you register with one of our websites/apps and/or enter into another contract with
us, we process the data necessary for the conclusion, performance or
termination of the contract with you. This includes:

The legal basis for this is Article 6(1)(a) and (b) DSGVO, i.e. you provide us with the
data on the basis of the respective contractual relationship (e.g. management
of your customer/user account, processing of a purchase contract) between you
and us. We are also obliged to process your email address in the event of a
purchase via our websites/apps due to legal requirements in the German Civil
Code (BGB) to send an electronic order confirmation (Article 6(1)(c) DSGVO).
Insofar as we do not use your data for advertising purposes (see 3.3 below), we store the
data collected for the processing of the contract for the duration of the
contract and until the expiry of the statutory or possible contractual warranty
and guarantee rights. After expiry of this period, we retain the information of
the contractual relationship required under commercial and tax law for the
periods determined by law. For this period, the data will be processed again
solely in the event of an audit by the tax authorities.
The following data processing is also required for the execution of a purchase
contract via our websites/applications:
Your payment details will be passed on to payment service providers commissioned by
us to process the payment(s). We pass on details of your delivery address to
logistics companies and shipping partners commissioned by us. In order to
ensure that the goods are delivered in accordance with your wishes, we transmit
your email address and, if applicable, telephone number to the logistics
company and/or shipping partner commissioned by us to carry out the delivery.
If necessary, they will contact you in advance of the delivery in order to
coordinate the details of the delivery with you. The respective data will be
transmitted solely for the respective purposes and deleted again after delivery
has taken place.
The legal basis for this data processing is Art. 6(1)(a) DSGVO.
3.2.2 Use of data for fraud prevention purposes
The data you provide in the context of an order may be used to check whether an atypical
order transaction has occurred (e.g. simultaneous ordering of a large number of
goods to the same address using different customer accounts). In principle, we
have a legitimate interest in carrying out such a check. The legal basis for
the processing is Art. 6(1)(f) DSGVO.
3.2.3 Transmission of data to transport service providers
For the purpose of delivering ordered goods, we work together with logistics service
providers/transport companies and/or shipping partners: The following data may
be transmitted to them for the purpose of delivery of the ordered goods or for
their announcement: First name, last name, postal address, email address,
telephone number (e.g. for shipping announcements).
The legal basis for the processing is Art. 6(1)(b) DSGVO.
3.2.4
Transmission of data on outstanding debts to collection service providers
If you fail to pay outstanding invoices/ instalments despite repeated reminders, we may
transfer the data required to carry out a debt collection to a debt collection
service provider for the purpose of trustee collection. Alternatively, we can
sell the outstanding receivables to a collection service provider. This service
provider then becomes the holder of the claim and asserts the claims in its own
name. The legal basis for the transfer of data within the scope of trustee
collection is Art. 6(1)(b) DSGVO; the transfer of data within the scope of the
sale of receivables is based on Art. 6(1)(f) DSGVO.
3.2.5 Transmission of data to partner companies
On our platform, you have the option to take advantage of offers from third-party
companies. In these cases, you may conclude a contract directly with our
partner, to whom the data required for the execution of the contract (e.g.
first name, surname, billing and delivery address, e-mail address, billing and
payment data, date of birth, telephone number) will be transmitted. Such
advantageous offers from our partners are recognisable as partner offers.
3.3 Data processing for advertising purposes
3.3.1 Postal advertising
We have a legitimate interest in using your data for marketing purposes. We process the following
data for our own marketing purposes and for the marketing purposes of third
parties: first name, last name, postal address, year of birth.
We are also entitled to store further personal data collected about you in compliance with
the legal requirements for our own marketing purposes as well as for the
marketing purposes of third parties. The aim is to send you advertising that is
geared solely to your actual or perceived needs and accordingly not to bother
you with useless advertising.
The additionally stored data will not be transmitted to third parties. In addition,
Horsebrands pseudonymises/anonymises personal data collected about you for the
purpose of using the pseudonymised/anonymised data for its own marketing
purposes and for the marketing purposes of third parties (advertisers).
The pseudonymised/anonymised data can also be used to advertise to you online on an
individualised basis, whereby the advertising can be targeted by third-party
service providers and/or agencies. The legal basis for the use of personal data
for marketing purposes is Art. 6(1)(f) DSGVO.

You can object to the use of your personal data for the afore mentioned marketing
purposes at any time free of charge with effect for the future at

If you object, your data will be blocked for further data processing for advertising
purposes. We would like to point out that in exceptional cases, advertising
material may still be sent temporarily after receipt of your objection. This is
technically due to the necessary lead time within the selection process and
does not mean that we have not implemented your objection.
3.3.2 Newsletter
On our websites/applications we offer you the possibility to register for our
newsletter. In order to ensure that no mistakes are made when entering the
e-mail address, we use the so-called double opt-in procedure (DOI procedure):
After you have entered your email address in the registration field and given
your consent to receive our newsletter, we will send you a confirmation link to
the email address you provided. Only when you click on this confirmation link
will your email address be added to our distribution list for sending our
newsletter.

You can revoke your consent at any time with effect for the future by sending a message
to service@horsebrands.de or using the unsubscribe option at the end of each

3.3.3 Competitions
If you register for competitions organised by Horsebrands, we shall use the data you
provide during the registration process for the purpose of implementing the
participation agreement, in particular to notify you of the prize and, if
applicable, to advertise our offers and/or offers from our competition
partners. You will find detailed information in the respective conditions of
participation for the respective competition. The legal basis for this data
processing is Article 6(1)(a) DSGVO, Article 6(1)(b) DSGVO and Article 6(1)(f)
DSGVO.
3.4 Online presence and website optimisation
3.4.1 Cookies - General Information
We use cookies on various pages to make visiting our website more attractive and to
enable the use of certain functions as well as to statistically record the use
of our website. Cookies are small text files that are automatically created by
your browser and stored on your end device (laptop, tablet, smartphone or
similar) when you visit our site. Cookies do not cause any damage to your end
device and do not contain any viruses, Trojans or other malware. Information is
stored in the cookie that is related to the specific end device used. However,
this does not mean that we gain direct knowledge of your identity.

the legal basis for the data processing is Art. 6(1)(f) DSGVO. Our interest in
optimising our website is to be regarded as legitimate in the sense of the
afore mentioned provision.
3.4.2 Google Analytics
For the purpose of demand-oriented design and continuous optimisation of our pages, we
use Google Analytics, a web analytics service provided by Google Inc.
("Google"). Google Analytics uses "cookies", which are text
files placed on your computer, to help the website analyse how users use the
site. In this context, pseudonymised usage profiles are created and cookies are
used. The information generated by the cookie about your use of this website is

3.4.3 Google AdWords
Our website uses the Google AdWords service. Google AdWords is an online advertising
programme of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043,
USA ("Google").
On the one hand, we use the remarketing function within the Google AdWords service. With
the remarketing function, we can present users of our website with
advertisements based on their interests on other websites within the Google
display network (on Google itself, so-called "Google Ads" or on other
websites). For this purpose, the interaction of users on our website is
analysed, e.g. which offers the user was interested in, in order to be able to
display targeted advertising to users on other sites even after they have

3.4.4 Google conversion tracking
Furthermore, we use the so-called conversion tracking within the scope of using the Google
AdWords service. When you click on an ad placed by Google, a cookie for
conversion tracking is stored on your computer/end device. These cookies lose
their validity after 30 days, do not contain any personal data and are
therefore not used for personal identification. The information obtained using
the conversion cookie is used to create conversion statistics for AdWords
customers who have opted for conversion tracking.

3.4.5 Targeting
The so-called targeting measures listed below and used by us are carried out on the
basis of Article 6 paragraph 1 letter f) DSGVO. We use the targeting measures
to ensure that you are only shown advertising on your end devices that is
geared to your actual or presumed interests, in order to avoid annoying you
with advertising that is not of interest to you.
3.4.5.1 Re-targeting
We also use re-targeting technologies from external service providers, such as the Facebook
Ireland Limited pixel. Re-targeting enables us to make our online offer more
interesting and tailored to you. This allows us to target those users on our
partners' websites with online advertising who have already shown interest in
our shop and our products. We know from studies that the display of
personalised, interest-related advertising is more interesting for internet
users than advertising that has no such personal reference.
A cookie is set for this purpose, with which interest data is collected using pseudonyms.
Based on this information, interest-related advertisements about our offers are
displayed on the websites of our partners. No directly personal data is stored
and no usage profiles are merged with personal data about you.
You have the option to deactivate the collection of data for the purpose of personalised
advertising. A cookie will then be set that permanently prevents the collection
of data, unless you delete this cookie in your browser specifically or via the
"Delete all cookies" function. You can repeat the objection at any
time.
3.4.8 Advertising partners/Third party cookies
We work together with advertising partners to make the online offer on our site even

We use social plug-ins from the social networks Facebook and WhatsApp on our website

interest within the meaning of the DSGVO. The responsibility for data
protection-compliant operation is to be ensured by their respective providers.
The purpose and scope of the data collection and the further processing and use of the data
by the respective provider, as well as your rights in this regard and setting

By logging out of the pages of social networks beforehand and deleting cookies that have
been set, you can prevent social networks from assigning the information
collected about you to your user account with the respective social network

Horsebrands offers the user the option of logging in to the service with his or her
Facebook account (so-called Facebook Connect function). Facebook Connect is a

Additional registration with Horsebrands is then not required. To register, the
user is redirected to the Facebook website, where he can log in with his usage

name, last name, email address, profile picture, gender, friends list). We use

3.5.2WhatsApp
This website also uses a WhatsApp button (WhatsApp share button). This button allows
you to share horsebrands.co.uk content via the WhatsApp application on your
mobile phone. The button is a hyperlink. When the button appears on this
website, no personal data is transmitted to the operator of WhatsApp or other
third parties. As soon as you use the WhatsApp button, the operator of WhatsApp
learns what content is being shared and that the button has been used on this

based on Article 6 (1) (b) and (a) DSGVO.
You have the option to delete your customer account at any time. Please note, however,
that once you have placed an order with us, this does not mean that the data
visible in the customer account will be deleted at the same time. Your data
will be deleted automatically after expiry of the retention obligations
applicable to us under commercial and tax law. The legal basis for this further

3.7 Contacting us
You have the possibility to contact us in several ways. By e-mail, by telephone or by
post. When you contact us, we use the personal data that you voluntarily
provide in this context solely for the purpose of contacting you and processing
your enquiry.
The legal basis for this data processing is Art. 6(1)(a), Art. 6(1)(b), Art. 6(1)(c)
DSGVO and Art. 6(1)(f) DSGVO.
3.8 Customer reviews/comments
You have the opportunity to publish your own content on horsebrands.de at various points
(e.g. product ratings, comments, etc.). When you submit a comment,
recommendation or rating on products, brands and styles, we process the
personal data that you voluntarily enter in the context of the comment or
rating. You can publish content on horsebrands.de under a pseudonym and/or your
first name and shortened surname. When users leave comments or other
contributions on horsebrands.de, their IP addresses are recorded on the basis
of our legitimate interests within the meaning of Art. 6 para. 1 letter f).
DSGVO are stored for 7 days. This is done for our security in case someone
leaves unlawful content in comments and posts (insults, prohibited political
propaganda, etc.).
The legal basis for this data processing(s) is Art. 6(1)(a), Art. 6(1)(b) and Art.
6(1)(f) DSGVO.
3.9Payments
We process your payment information for the purpose of payment processing, e.g. if you
purchase or use a product and/or service via horsebrands.de. Depending on the
payment method, we may forward your payment information to third parties (e.g.
in the case of credit card payments, to your credit card provider).
The legal basis for this data processing is Art. 6(1)(a), Art. 6(1)(b), DSGVO and Art.
6(1)(f) DSGVO.
3.9.1 PayPal
When paying via PayPal, your payment data will be forwarded to PayPal (Europe) S.à r.l. et
Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to
as "PayPal") as part of the payment processing. PayPal reserves the
right to conduct a credit check for the payment methods credit card via PayPal,
direct debit via PayPal or - if offered - "purchase on account" via
PayPal. PayPal uses the result of the credit check with regard to the
statistical probability of non-payment for the purpose of deciding on the
provision of the respective payment method. The credit report may contain
probability values (so-called score values). Insofar as score values are
included in the result of the credit report, they have their basis in a
scientifically recognised mathematical-statistical procedure. Among other
things, address data is included in the calculation of the score values. For

4.recipients outside the EU
With the exception of the processing described above, we do not pass on your data to
recipients based outside the European Union or the European Economic Area. The
aforementioned processing operations include the transfer of data to the
servers of the providers of tracking and targeting technologies commissioned by
us. These servers are located in the USA. The data transfer takes place on the
basis of so-called standard contractual clauses of the EU Commission and
according to the principles of the so-called Privacy Shield.
5 Your rights
5.1 Overview
In addition to the right to withdraw the consent you have given to us, you have the
following further rights if the relevant legal requirements are met:
the right to information about your personal data stored by us (Art. 15 DSGVO), in
particular you can request information about the processing purposes, the
category of personal data, the categories of recipients to whom your data has
been or will be disclosed, the planned storage period, the origin of your data
if it has not been collected directly from you;
the right to have inaccurate data corrected or to have correct data completed (Art. 16 of
the GDPR),
the right to have your data stored by us deleted (Art. 17 DSGVO), insofar as no legal or
contractual retention periods or other legal obligations or rights to further
storage are to be observed by us,
the right to restrict the processing of your data (Art. 18 DSGVO), insofar as the
accuracy of the data is disputed by you, the processing is unlawful, but you
object to its deletion; the controller no longer requires the data, but you
